These Terms of Service (“Terms”) govern the use of services provided by FlowIQ Systems (“Company,” “we,” “us,” or “our”). By purchasing, accessing, or using FlowIQ Systems, you (“Client,” “you,” or “your”) agree to be bound by these Terms.

1. SERVICES OVERVIEW

FlowIQ Systems provides a business management and automation platform designed to help businesses capture, manage, follow up with, and organize leads through CRM tools, automations, messaging, scheduling, and analytics (“Platform”).

FlowIQ Systems does not guarantee leads, sales, revenue, or business outcomes.

2. REQUIRED SYSTEM IMPLEMENTATION

2.1 Mandatory Setup

All clients are required to purchase a one-time System Setup & Implementation prior to platform access.

This implementation ensures the platform is:

• Properly installed

• Configured for Client’s business

• Tested and operational

Platform access will not be granted until setup is completed and payment is received.

2.2 Scope of Setup

System Setup may include:

• Platform configuration

• CRM and pipeline setup

• Calendar configuration

• Messaging and notification workflows

• AI assistant configuration

• Branding application (logo/colors if provided)

• Forms and intake configuration

• Basic automation testing

• Customization beyond the defined scope may require additional fees.

3. SUBSCRIPTION TERMS

3.1 Billing

• FlowIQ operates on a monthly subscription model

• Fees are billed in advance

• Subscription is month-to-month unless otherwise stated

• Payment method must remain on file

3.2 Failed Payments

If payment fails:

• Access may be suspended

• Automations may stop

• Data retention is not guaranteed

4. NO PERFORMANCE GUARANTEES

FlowIQ Systems provides software and automation tools only.

We do not guarantee:

• Lead volume

• Conversion rates

• Revenue

• Sales outcomes

• Ad performance

• Business growth

Client acknowledges that results depend on multiple factors outside FlowIQ’s control, including business practices, response time, market conditions, and follow-through.

5. OPTIONAL TRAFFIC SERVICES

Any advertising or traffic-related services:

• Are optional

• Are billed separately

• Require the system to be fully installed first

• Do not include performance guarantees

• May require minimum commitments

FlowIQ Systems is not responsible for ad spend, platform suspensions, or third-party account issues.

6. CLIENT RESPONSIBILITIES

Client agrees to:

• Provide accurate business information

• Respond promptly during setup

• Maintain compliance with communication laws (TCPA, CAN-SPAM, etc.)

• Obtain proper consent from leads

• Use the platform legally and ethically

FlowIQ Systems is not liable for misuse of the platform.

7. SUPPORT & LIMITATIONS

Support is limited to:

• Platform-related questions

• Troubleshooting system functionality

Support does not include:

• Business coaching

• Sales training

• Custom coding

• Strategy consulting unless explicitly agreed upon

8. TERMINATION

• Client may cancel their subscription at any time.

• Setup fees are non-refundable

• Subscription fees are non-refundable once billed

• Upon cancellation, access to the platform will be revoked

9. DATA & OWNERSHIP

• Client owns their data

• FlowIQ Systems may delete or archive data after cancellation

• Client is responsible for exporting data prior to termination

10. LIMITATION OF LIABILITY

FlowIQ Systems shall not be liable for:

• Lost revenue

• Missed opportunities

• Data loss

• Business interruption

• Third-party service issues

Total liability shall not exceed the amount paid by Client in the previous 30 days.

11. MODIFICATIONS

FlowIQ Systems reserves the right to modify these Terms at any time. Continued use of the platform constitutes acceptance of updated Terms.

12. GOVERNING LAW

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.
